1. About These Terms

These terms apply when you instruct AG Garden & Tree to carry out work. AG Garden & Tree is operated by Antony Geer as a sole trader, based in Burgess Hill, West Sussex.

By accepting a quotation (whether verbally, in writing, or by allowing work to commence) you agree to these terms. Please read them before accepting a quote. If anything is unclear, ask Antony and he will be happy to explain.

2. Quotations & Pricing

  • All quotations are provided free of charge following a site visit or assessment.
  • Quotes are valid for 30 days from the date issued, unless stated otherwise.
  • Prices are based on what we can see and assess at the time of the visit. If we discover additional work once we start (for example, hidden decay, unexpected root systems, or access difficulties) we will discuss any changes and agree additional costs with you before proceeding.
  • Payment is due on completion of work unless otherwise agreed in writing.
  • We accept payment by cash or bank transfer.

3. Your Responsibilities

To help us carry out the work safely and efficiently, we ask that you:

  • Confirm ownership or authority: You must be the property owner or have the owner's written permission for the work to be carried out.
  • Disclose protected trees: If any trees are subject to a Tree Preservation Order (TPO) or the property is in a Conservation Area, you must inform us before work begins. We can check and apply for the necessary permissions on your behalf, but the legal responsibility for carrying out unauthorised work rests with the property owner.
  • Bird nesting season: Under the Wildlife and Countryside Act 1981, it is an offence to disturb nesting birds. If we find an active nest during the nesting season (generally March to August), we may need to postpone work until the nest is no longer in use. This is a legal requirement and is not grounds for cancellation or withholding payment for work already completed.
  • Provide safe access: Ensure we have reasonable access to the site for our team and equipment, including parking where possible.
  • Clear the work area: Remove or protect personal belongings, garden furniture, vehicles, and anything else that could be damaged in the working zone.
  • Inform us of underground services: Let us know about any underground utilities (gas, water, electric, drainage) in the area where we will be working, particularly for stump grinding.

4. Our Responsibilities

  • All tree work is carried out in accordance with BS 3998 (Tree Work: Recommendations) and, where applicable, BS 5837 (Trees in Relation to Design, Demolition and Construction).
  • All operatives are City & Guilds NPTC qualified and hold current certifications for the work being undertaken.
  • We carry £5 million public liability insurance through Convex Insurance. Proof of insurance is available on request.
  • We will leave the site clean and tidy, removing all waste unless you ask us to leave timber or logs.
  • We will take reasonable care to protect your property, fences, lawns, and driveways during the work.

5. Cancellation

  • You may cancel a booking at any time before work begins, with no charge.
  • If you cancel after work has started, you will be liable for the cost of work already completed and any materials ordered specifically for your job.
  • For agreements made at your home, you have a 14-day cooling-off period under the Consumer Contracts Regulations 2013, starting from the date you accepted the quote. If you asked us to start work within the cooling-off period and then wish to cancel, you agree to pay for the work completed up to that point.
  • We reserve the right to postpone or reschedule work due to adverse weather conditions, discovery of nesting birds, or safety concerns. In these cases, we will rearrange at no additional cost.

6. Liability & Limitations

  • We are liable for any damage to your property caused by our negligence. Claims should be reported within 7 days of completion.
  • Our total liability for any single claim shall not exceed the value of our insurance cover (£5 million).
  • We are not liable for:
    • Damage to surfaces already in poor condition (e.g. cracked paving, loose fencing).
    • Changes to light levels, views, or wind exposure following tree removal or reduction. These are expected consequences of the work.
    • Subsidence or heave that may occur after tree removal, which is a known natural process.
    • The ongoing health of trees not included in the agreed scope of works.
  • Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

7. Complaints & Disputes

If you are unhappy with any aspect of our work, please contact Antony directly:

Please report any issues within 7 days of the work being completed so we can assess and resolve them promptly.

Our work is verified by Checkatrade and TrustATrader, and you are welcome to leave a review through either platform.

If we are unable to resolve a dispute, you may refer the matter to your local Trading Standards office or use the courts of England and Wales.

8. Photography

We may photograph completed work for use on our website, social media, and marketing materials (for example, our project portfolio). We will never include images that identify your property address without your prior consent.

9. Changes to These Terms

We may update these terms from time to time. The version in effect at the time you accept your quotation applies to that work. The latest version is always available on this page.
